Any commercial use of the Software, including but not limited to incorporating it into commercial products, using it for commercial gain, or providing commercial services based on the Software, is strictly prohibited without explicit written authorization from IRC.com.
IRC.com retains all right, title, and interest in and to the Software, including all intellectual property rights therein. This license does not transfer any ownership rights to you.
The Software contains proprietary and confidential information that is protected by applicable intellectual property and other laws. You acknowledge that the Software contains trade secrets and proprietary information of IRC.com.
The Software is protected by United States and international copyright laws, trademark laws, and treaty provisions. The Software contains copyrighted material, including but not limited to source code, object code, documentation, graphics, user interface elements, and other creative works owned by IRC.com.
You agree not to remove, alter, obscure, or modify any copyright notices, trademark notices, proprietary legends, or other proprietary rights notices contained in or on the Software. Any attempt to do so will result in immediate termination of this license.
Violation of IRC.com's copyright may result in severe civil and criminal penalties. Copyright infringement is punishable under federal law by fines up to $150,000 per work infringed and potential imprisonment. IRC.com will vigorously pursue all available legal remedies against copyright infringers.
You agree not to circumvent, disable, or otherwise interfere with security-related features of the Software, including features that prevent or restrict the copying or use of content.
IRC.com reserves the right to monitor compliance with this license agreement through technical means and may implement measures to detect and prevent unauthorized use.
If you discover security vulnerabilities in the Software, you agree to report them responsibly to IRC.com through appropriate channels rather than exploiting or disclosing them publicly.
The Software may incorporate open source software components, each governed by their respective licenses. Such licenses are available upon request and do not grant additional rights to the proprietary portions of the Software.
Your use of any third-party components is subject to the terms and conditions of their respective licenses, which may impose additional restrictions.
This license will automatically terminate if you fail to comply with any of its terms and conditions. Upon termination, you must immediately cease all use of the Software.
IRC.com reserves the right to pursue all available legal remedies for violations of this license, including but not limited to injunctive relief, monetary damages, and attorney's fees.
The restrictions and obligations set forth in this license will survive any termination of your rights to use the Software.
If you wish to use the Software for commercial purposes, including integration into commercial products or services, you must obtain a separate commercial license from IRC.com.

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. IRC.COM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL IRC.COM BE LIABLE FOR ANY DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF IRC.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
This license agreement is governed by the laws of the State of Delaware, without regard to conflict of law principles.
This license agreement supplements and works in conjunction with the IRC.com Terms of Service. In case of conflict between this license and the Terms of Service, the more restrictive provision shall apply.
If any provision of this license is found to be unenforceable, the remainder of the license shall remain in full force and effect.
This license agreement, together with the Terms of Service, constitutes the complete agreement between you and IRC.com regarding the Software.

By using the IRC.com software, you acknowledge that you have read, understood, and agree to be bound by this Software License Agreement. Violation of these terms will result in immediate termination of your license and may subject you to legal action.
